Tampa partners Ella Shenhav and Michael Silver recently co-authored an article titled “What Every Business Should Know About the Proposed American Data Privacy and Protection Act,” published by the Tampa Bay Business Journal.
In the article, Ella and Michael explain that Congress is considering enacting the American Data Privacy and Protection Act, which, if enacted in its current form into law, would create a strict and demanding uniform federal standard for data privacy, preempting state laws.
“The new provisions proposed in the ADPPA, would create an umbrella statute that could simplify the confusing task of deciphering the complex legal landscape of privacy regulations. But the ADPPA, if enacted, would also increase businesses’ obligations and would create a new federal Bureau of Privacy to focus on enforcement. Tampa Bay’s thriving business community, which includes, among many other businesses, robust high-tech and health industries that are often closely watched for potential privacy violations, should be particularly cognizant of this impending change and plan accordingly,” state Ella and Michael.
The ADPPA may serve as a blueprint for new state laws even if it is not enacted.
