Insurance

We represent some of the nation’s largest insurers (including several Fortune 100 companies) in connection with life, health, long-term care, property, casualty, and individual and group disability insurance defense. Our insurance attorneys have extensive experience with claim-handling issues, coverage actions, tort claims, bad faith litigation, class action defense, and appeals in state and federal court.

We have represented insurers in a broad range of high-profile proceedings, including a recent Florida Supreme Court case concerning the attorney-client privilege in first-party bad faith insurance actions. In a major victory for the industry, the Court held that the Florida bad faith statute does not revoke an insurer’s attorney-client privilege protection in bad faith lawsuits.

In another matter on behalf of the largest global provider of insurance and annuities, our team successfully defended a “faked death” case involving a $2 million life insurance policy. In entering summary judgment for our client, the Court held that the relevant policy language gave the insurer discretion to determine whether “proof of death” was sufficient.

Our insurance attorneys are well renowned in the field, having earned recognition from reputable ranking organizations such as Chambers USA and Best Lawyers in America®. In addition, the firm has been listed for more than 25 years in Best’s Client Recommended Insurance Attorneys.

At Shutts & Bowen, our insurance clients can rely on our extensive litigation and appellate experience, comprehensive knowledge of the industry, and unmatched commitment to professional, cost-effective service.
