Overview

Brian K. Wright is a partner in the Tampa office of Shutts & Bowen LLP, where he practices corporate and health care law and is a member of the Corporate Practice Group.

Brian is a Florida Bar Board Certified Specialist in Health Law, and has been recognized as a “Rising Star” by Florida Super Lawyers in Health Care.

He advises health care clients on regulatory issues including physician employment agreements, HIPAA and HITECH compliance (HIPAA Final Omnibus Rule), health care operations compliance, facility licensure and permit requirements, including pharmacies, Medicare and Medicaid credentialing and audit matters, Stark Law and Anti-kickback analysis, including self-disclosure matters, and medical practice acquisitions and sales. Brian also has representative experience advising clients on professional licensure defense actions, peer review matters, advance directives, fraud and abuse, and payor litigation, including PIP reimbursement and hospital lien issues.

In addition to this health care law practice, Brian advises clients on general corporate matters, including the sale or acquisition of businesses through asset or stock transfers as well as compliance matters and the preparation of executive employment agreements.

Brian is a second career attorney, having worked with major pharmaceutical companies while providing business operations oversight to a private medical practice. Brian’s experience in the business world provides him with an understanding of the business environment in which his health care clients operate.

Brian has also presented and written on various health care topics, including the tax implications of the Patient Protection and Affordable Care Act on 501(c)3 charitable hospitals, and has been published in The Florida Bar’s Health Law Section Newsletter.

  • Representation of clients before the Agency for Health Care Administration for licensure applications and Medicaid audits
  • Representation of clients before the Florida Department of Health in professional licensure actions, as well as advise clients with multi-state reciprocal disciplinary actions
  • Assist clients with insurance and specialty board peer review matters
  • Assist clients with payment reviews involving Medicare payments, both RAC and ZPIC audits
  • Advise a regional Health Information Exchange with connectivity to the State of Florida on formation regulatory compliance issues
  • Advise clients on fraud and abuse issues, including Stark Self-Disclosure Protocol
