Aliette Rodz Discusses How the Private Credit Market Could Impact South Florida Litigation

Aliette DelPozo Rodz, a partner in Shutts & Bowen LLP’s Miami office, was recently featured in a Law.com article titled, “Private Credit Boom: Miami’s Role as a Financial and Litigation Hub,” on November 25, 2024.

According to the Law.com article, the private credit market seems to be the next big thing in finance.

Aliette spoke to Law.com about how private credit is going to impact litigation in South Florida especially in Miami, saying that it is “going to drum up litigation; there's always that cycle.”

Aliette noted “There's the boom of investment, and then there's the restructuring and forbearance period where loans aren't paid on time. After that, we typically see a wave of foreclosures, which happens cyclically. Of course, it always depends on the market and how it's performing.”

Aliette also explained how people have a tendency to overextend themselves, which leads to foreclosures and the potential for disputes on loan modifications and forbearance. “We’re already starting to see some forbearance and debt restructuring, and that trend will continue to grow," she added. "This will have a significant impact, particularly in Florida—Miami and South Florida specifically—given the strong investment ties with South America,” said Aliette.
