Rachel LaMontagne, a Class Action and Mass Litigation partner in the Miami office of Shutts & Bowen, presented at the Second Annual Medicare Secondary Payer Conditional Payment Forum, a conference provided by Healthcare Education Associates. The conference took place at Sheraton Pentagon City Hotel in Arlington, VA from June 19-20.
Rachel presented “Are MAP and PDP Assignees Also Allowed Double Damages?” and addressed whether assignees of Medicare Advantage Plans and Prescription Drug Plans can recover double damages under the Medicare Secondary Payer Act. The presentation covered who the assignees are, how the obligations satisfy the MSP Act’s “demonstrated responsibility” requirement, the application of these issues to entities that have not accepted on going responsibility for medicals, as well as recent developments in secondary payer law.
Rachel also spoke on a panel titled “Best Practice Tips on MAP, Assignees, Providers and Beneficiary Claims.” The group discussed best practice tips for finding the Medicare Advantage and Prescription Drug Plan and considerations when responding to an Assignee’s claim for reimbursement. The panel also covered strategies that could prevent medical providers from filing MSP claims, and offered tips to prevent a claimant and/or counsel from seeking double damages under the MSP Act.
