Shutts Attorneys Selected to Contribute to The Florida Bar’s Real Property Litigation Manual

Three partners at Shutts & Bowen LLP, Matthew R. Chait, Michelle G. Hendler, and Matthew S. Sackel, were chosen by The Florida Bar to contribute to the ninth edition of “Florida Real Property Litigation,” an essential resource for attorneys practicing real estate law in Florida.

“It’s an honor when one of our partners is recognized by The Florida Bar, for their preeminent knowledge,” said Michael J. Grindstaff, Managing Partner at Shutts. “We are proud that three of our own were chosen by The Bar to be part of the elite group, whose work will be referenced by real estate lawyers across the state.”

The reference manual, which was published on Dec. 19, is known as the go-to publication for real estate litigation issues in the Sunshine State, and provides invaluable statutory and case analysis, pleading forms, and practice pointers.

“I’m honored that The Florida Bar asked me to contribute once again,” said Chait, a partner in the Business Litigation Practice Group of Shutts’ West Palm Beach office. He was tapped to pen the publication’s twelfth chapter which focuses on Landlord and Tenant Disputes for both the eighth and ninth editions.

Hendler authored the first two sections of the publication’s chapter that discuss foreclosures, specifically General Foreclosure Procedures and Commercial Mortgages. The commercial chapter adeptly explains the ruling in HSBC Bank USA, National Association v. Buset, which was recently was handed down by the Third District Court of Appeal and clarified some of the issues frequently litigated between lenders and borrowers.

“It’s the best first stop primer for real estate law,” said Hendler, a partner in the Creditors’ Rights Practice Group of Shutts’ Miami office. “It’s honor to be part of this publication and that our collective years and depth of experience in real estate litigation are acknowledged and can be shared with others.”

Sackel, also a partner in the Business Litigation Practice Group in the firm’s West Palm Beach office, authored the eighth and ninth editions’ chapter on the Enforcement of Restrictive Covenants, which addresses recent case law regarding the cancellation of a restrictive covenant due to an alleged change in circumstances.

“It is gratifying to know that we’re helping litigators across the state maneuver through the intricacies of Real Property Law,” Sackel said.
